General office of the State Council (12.2020) “Guiding opinions on further perfecting the system of credit-breaking restraint and constructing a long-term mechanism of credit system” requirements: According to the general idea of law & regulation, protection of the legitimate rights and interests, prudence and moderation, list management, standardize and improve the mechanism of credit-breaking punishment and credit repair, promote the social credit system into a new stage of high-quality development. This paper explores the theoretical basis of credit restraint in the perspective of economic theory, analyses the types and effective elements of credit-breaking punishment from the perspective of mechanism building, summarizes the problems existing in privacy protection and credit repair mechanism of credit-breaking punishment measures, puts forward some suggestions on the formulation of social credit information catalogue & credit-breaking punishment measures list.
