ABSTRACT

With the advancement of globalization, the conflict between state sovereignty and investor protection has become increasingly prominent in international investment law. This article analyzes the origins of this conflict and its manifestation in international investment arbitration, particularly in areas such as expropriation, environmental policies, and public health. By examining classic cases, it reveals how international investment treaties protect investor rights while impacting the flexibility of state policies. Finally, the article explores the necessity of reforming international investment arbitration mechanisms and proposes a more balanced legal framework to reconcile state sovereignty and investor protection.
