ABSTRACT

This paper aims to study the legal regulations regarding third-party participation in criminal electronic data forensics. By explaining the concept and importance of electronic data forensics, as well as analyzing relevant laws and regulations domestically and internationally, the roles and responsibilities of third parties in electronic data forensics are explored, along with an assessment of the advantages and disadvantages of their involvement. The paper also provides suggestions for improvement based on an analysis of the current legal regulations in China. The analysis of the domestic legal framework examines the existing laws and regulations concerning third-party participation in criminal electronic data forensics, supplemented by discussions on relevant judicial precedents and practical experiences. International experiences are then considered to examine the legal regulations for third-party involvement in electronic data forensics abroad, including international cooperation.
